These Terms and Conditions ("Terms") constitute a legally binding agreement between Savanna Journeys, a travel consultancy company registered in Kenya ("we", "us", "our", or "the Company"), and you ("you", "your", or "Client") regarding the provision of travel consultancy and booking services.

By engaging our services, submitting a booking inquiry, making a payment, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

Nature of Services - Agency Relationship

Important Notice

Savanna Journeys acts as a mere agent for all suppliers of services and accommodations advertised and/or sold by us. All suppliers of services and accommodations are third-party vendors and Savanna Journeys retains no ownership interest, management, or control of those third-party vendors.

Services We Provide

We provide travel consultancy services including:

  • Destination advice and recommendations for Kenya, Uganda, Rwanda, and Tanzania
  • Itinerary planning and customization
  • Facilitation of bookings with third-party suppliers
  • Coordination of travel arrangements on behalf of clients
  • General travel information and guidance

Third-Party Suppliers

Our third-party suppliers may include:

  • Hotels, lodges, resorts, and other accommodation providers
  • Safari operators and tour companies
  • Ground transportation providers
  • Activity and excursion operators
  • Airlines and other carriers
  • Any other service provider involved in your travel arrangements

No Liability for Third-Party Services

To the fullest extent permitted by law, Savanna Journeys does not assume liability for any injury, damage, death, loss, accident, delay, inconvenience, or irregularity due to an act or omission of any third parties (including third-party vendors), governmental authority, force majeure events, or acts attributable to you yourself, including negligent or reckless acts.

Bookings and Payments

Booking Process

All bookings are subject to availability and confirmation by third-party suppliers. A booking is only confirmed when:

  • We have received your completed booking form or written confirmation
  • Payment has been received as per our payment terms
  • Written confirmation has been issued by us or the supplier

Payment Terms

Unless otherwise agreed in writing:

  • A deposit is required to secure your booking (amount varies by package)
  • Full payment must be received as specified in your booking confirmation
  • Payment can be made via bank transfer, credit card, or other approved methods
  • All prices are in USD unless otherwise stated
  • Additional charges may apply for special requests or services

Price Validity and Changes

Prices quoted are valid for 14 days from the date of quotation unless otherwise stated. We reserve the right to adjust prices due to changes in exchange rates, increases in supplier costs, changes in government taxes or fees, or fuel surcharges. We will notify you of any price changes before confirming your booking.

Commission Disclosure

We earn commission from third-party suppliers for bookings facilitated through our services. This commission does not increase the cost to you and is a standard industry practice. Our recommendations are based on quality, suitability, and value.

Cancellation and Refund Policy

Cancellation by Client

All cancellations must be notified to us in writing via email. The cancellation will be effective from the date we receive written notice. Cancellation charges will apply as follows:

  • 60+ days before departure: 10% cancellation fee
  • 30-59 days before departure: 25% cancellation fee
  • 15-29 days before departure: 50% cancellation fee
  • 14 days or less: 100% cancellation fee (no refund)

Important: The above are our administrative cancellation charges. Supplier-specific cancellation policies will also apply and may be more restrictive. You will be liable for both our charges and any charges imposed by suppliers.

Amendments by Client

Any changes to confirmed bookings are subject to availability and may incur our administrative amendment fee plus any charges imposed by suppliers. We cannot guarantee that amendments will be possible. Some bookings may be non-amendable.

Cancellation by Savanna Journeys or Suppliers

We or our suppliers reserve the right to cancel bookings due to:

  • Insufficient bookings (for group tours)
  • Force majeure events
  • Safety or security concerns
  • Supplier insolvency or operational issues

In such cases, we will offer alternative arrangements of comparable standard or a full refund. We are not liable for any consequential losses, expenses, or damages arising from such cancellation.

Refund Processing

Refunds, where applicable, will be processed within 30 days of receiving cancellation confirmation and will be subject to deduction of applicable cancellation charges and receipt of refunds from suppliers.

Client Responsibilities

Travel Documentation

You are solely responsible for ensuring you have:

  • A valid passport with at least six months validity beyond your return date
  • Appropriate visas for all countries you will visit or transit through
  • All required health certificates and vaccination records (including Yellow Fever where applicable)
  • Any other documentation required by immigration, customs, or health authorities

We provide general guidance on documentation requirements but cannot guarantee accuracy as requirements change frequently. You must verify current requirements with the relevant embassies or consulates.

Health and Safety

You must:

  • Ensure you are medically and physically fit for the activities included in your itinerary
  • Disclose any medical conditions, disabilities, or special requirements that may affect your travel
  • Obtain necessary vaccinations and antimalarial medication as recommended for East Africa
  • Consult your physician regarding fitness for activities such as gorilla trekking or high-altitude travel
  • Follow park rules and guide instructions at all times
  • Understand that wildlife viewing involves inherent risks that you assume

Travel Insurance - Strongly Recommended

You are strongly required to obtain comprehensive travel insurance covering at minimum:

  • Medical expenses and emergency evacuation
  • Trip cancellation and interruption
  • Lost or delayed baggage
  • Personal liability
  • Activities you will undertake (safaris, trekking, water sports, etc.)

We may require proof of insurance before confirming bookings for certain activities. Travel without adequate insurance is at your own risk.

Accurate Information

You must provide accurate and complete information including:

  • Full names as they appear on passports
  • Contact details and emergency contact information
  • Dietary requirements, allergies, or medical conditions
  • Any special requests or requirements

We are not responsible for issues arising from inaccurate or incomplete information provided by you.

Compliance and Behavior

You must:

  • Comply with all laws and regulations of countries visited
  • Comply with all supplier rules and regulations
  • Behave responsibly and respectfully toward local communities, wildlife, and the environment
  • Follow instructions from guides and tour leaders
  • Arrive at designated meeting points on time

We reserve the right to terminate your services without refund if your behavior is deemed inappropriate, illegal, or detrimental to other travelers or our reputation.

Minors

If traveling with minors (persons under 18 years):

  • You must provide parental/guardian consent
  • Minors must be accompanied by a responsible adult at all times
  • Additional documentation may be required (birth certificates, consent letters)
  • You are responsible for the minor's safety and behavior

Limitations of Liability

Maximum Liability

To the maximum extent permitted by Kenyan law, our total liability to you for any claim arising out of or in connection with our services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount paid by you to us for the specific booking giving rise to the claim.

Exclusions

We shall not be liable for:

  • Any indirect, consequential, special, or punitive damages
  • Loss of enjoyment, distress, or disappointment
  • Loss of profits, business, revenue, or contracts
  • Wasted expenditure or costs of alternative arrangements
  • Any losses arising from events beyond our reasonable control

Time Limits for Claims

Any claim against us must be notified to us in writing within 30 days of the end of your trip or the date when the issue arose, whichever is earlier. Failure to notify us within this period may result in the claim being barred.

Force Majeure

We shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control including:

  • Acts of God, natural disasters, extreme weather conditions
  • War, terrorism, civil unrest, or political instability
  • Epidemics, pandemics, or health emergencies
  • Government actions, travel restrictions, or border closures
  • Strikes, labor disputes, or transportation disruptions
  • Supplier insolvency or operational failure

In such circumstances, we will use reasonable efforts to provide alternative arrangements but are not obligated to do so and are not liable for any costs, losses, or expenses incurred.

Supplier Terms and Conditions

All services are provided subject to the terms and conditions of the respective suppliers. By booking through us, you agree to be bound by all applicable supplier terms and conditions. Each supplier's liability is governed by their own terms and conditions, which may limit or exclude liability.

Complaints About Suppliers

Any complaints regarding supplier services must be reported:

  • Immediately to the supplier on-site for resolution
  • To us within 24 hours via email or phone
  • Formally in writing within 30 days of your return

Failure to report issues promptly may affect your ability to claim compensation.

Intellectual Property

All content on our website, marketing materials, and itineraries including text, graphics, logos, images, and software are the property of Savanna Journeys or our licensors and are protected by Kenyan and international intellectual property laws.

Itineraries and travel information provided to you are for your personal, non-commercial use only. You may not reproduce, distribute, sell, or use our content for commercial purposes without our written permission.

Photography and Media Release

By participating in our tours, you consent to the use of photographs, videos, or other media taken during the tour for promotional purposes. If you prefer not to be photographed or filmed, please inform your guide at the beginning of the tour.

Some locations, communities, and activities may restrict photography or require permits. You are responsible for complying with all photography restrictions and obtaining necessary permissions.

Special Circumstances

Accessibility and Special Needs

If you have accessibility requirements or special needs, you must inform us at the time of inquiry. We will make reasonable efforts to accommodate your needs but cannot guarantee suitability of all services. Many safari vehicles, lodges, and activities in East Africa have limited accessibility features.

Dietary Requirements

Please inform us of any dietary requirements, allergies, or restrictions at the time of booking. We will communicate these to suppliers, but we cannot guarantee suppliers will be able to accommodate all requirements, particularly in remote locations.

Wildlife and Safari Activities

Wildlife viewing is subject to nature and cannot be guaranteed. Safari itineraries may be adjusted based on weather, animal movements, park regulations, and safety considerations. We are not liable for any wildlife sightings not achieved or activities curtailed for safety reasons.

Data Protection and Privacy

In accordance with the Kenya Data Protection Act, 2019, we collect, use, and process your personal data to process your booking, provide our services, communicate with you, share necessary information with suppliers, and comply with legal requirements.

We implement appropriate technical and organizational measures to protect your personal data. Under the Kenya Data Protection Act, you have the right to access, correct, or request deletion of your personal data, subject to legal requirements.

Important Disclaimers

Information Accuracy

While we make reasonable efforts to ensure information provided is accurate and current, we do not warrant the accuracy of destination information (which may change), the completeness of supplier information, or that services will meet your specific requirements.

Recommendations

Our recommendations are based on our knowledge and experience but are subjective. Your satisfaction with destinations, accommodations, and activities depends on personal preferences and expectations.

Assumption of Risk

Travel to East Africa involves inherent risks including but not limited to:

  • Health risks (malaria, altitude sickness, waterborne diseases)
  • Wildlife encounters
  • Road conditions and transportation risks
  • Political or civil unrest
  • Natural disasters

By traveling, you voluntarily assume all risks associated with your trip.

Complaints and Dispute Resolution

Complaint Procedure

If you have a complaint:

  1. Report issues immediately on-site to the supplier and to us via phone or email
  2. If unresolved, submit a formal written complaint within 30 days of your return, including booking reference, detailed description, supporting evidence, and your desired resolution
  3. We will acknowledge your complaint within 7 working days and provide a response within 28 days

Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of Kenya. The Kenyan courts shall have exclusive jurisdiction over any disputes arising from these Terms.

General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and us.

Amendments: We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Consumer Rights: Nothing in these Terms affects your statutory rights under the Consumer Protection Act, 2012 of Kenya or other applicable consumer protection legislation.

Acknowledgment

By proceeding with a booking, you acknowledge that you have read and understood these Terms and Conditions in their entirety, agree to be bound by these Terms, have the authority to accept these Terms on behalf of all persons included in the booking, understand that Savanna Journeys acts solely as an agent for third-party suppliers, accept the limitations of liability and disclaimers contained herein, and understand your responsibilities regarding travel documentation, insurance, and health requirements.
